THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSTLY STABLE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

Indemnity

You will defend and indemnify Mostly Stable against third-party claims arising from your use of the Service, your data or content, or your violation of these Terms, subject to our right to control the defense of claims where required by law.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or for operational reasons with notice where reasonable. Provisions that by their nature should survive will survive termination.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless mandatory local law requires otherwise. Courts in that jurisdiction have exclusive venue, subject to mandatory arbitration or consumer protections where applicable.

Changes

We may update these Terms from time to time. We will post the updated Terms and update the “Last updated” date. Material changes may require additional notice or consent where required by law. Continued use after changes become effective constitutes acceptance.
